1. Acceptance of Terms

By accessing or using Blyft ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

Blyft is an AI-powered full-stack web builder that allows users to generate, customize, and deploy fully functional websites by describing their requirements in natural language. The Service includes AI-generated code, a browser-based editor, template libraries, logo generation, landing page creation, promotional video generation, and associated analytics tools.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@blyft.io if you suspect unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to: • Generate applications that facilitate illegal activities, fraud, or harm to others. • Create malware, spyware, ransomware, or any malicious software. • Infringe on intellectual property rights of third parties. • Violate any applicable local, national, or international law or regulation. • Attempt to reverse-engineer, decompile, or extract proprietary models or infrastructure underlying the Service. • Scrape, mine, or harvest data from the Service without prior written consent.

5. Intellectual Property

Applications, code, and assets generated by Blyft on your behalf are owned by you, subject to your compliance with these Terms. Blyft retains ownership of the underlying AI models, platform infrastructure, templates, and all proprietary technology used to generate those outputs. You grant Blyft a limited, non-exclusive license to process your prompts and input data solely for the purpose of providing the Service.

6. Subscription & Billing

Blyft offers free and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by applicable law. We reserve the right to change pricing with 30 days' advance notice. Failure to pay may result in suspension or termination of your account. You are responsible for all applicable taxes.

7. Credits & Usage Limits

Certain features of the Service operate on a credit-based system. Credits are consumed per generation and are not transferable between accounts. Unused credits expire at the end of each billing cycle unless otherwise stated in your plan. Blyft reserves the right to adjust credit allocations and pricing with notice.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process data as described in the Privacy Policy. You retain ownership of any data you input into the Service. By using the Service, you grant Blyft permission to use anonymized, aggregated usage data to improve our AI models and product offerings.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Blyft does not warrant that the Service will be uninterrupted, error-free, or that generated code will be free of defects or security vulnerabilities. You use any generated websites in production at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Blyft and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business, arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to Blyft in the 12 months preceding the claim.

11. Termination

Blyft reserves the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct we determine to be harmful to the Service, other users, or third parties. You may terminate your account at any time by contacting support@blyft.io. Upon termination, your right to access the Service will immediately cease. Sections 5, 9, 10, and 12 survive termination.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class-action participation in connection with any dispute relating to the Service.

13. Changes to These Terms

Blyft may update these Terms at any time. We will notify you of material changes via email or a prominent notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.
